UK – Decision to destroy cheeses is reversed – E.coli

A sheriff who condemned four batches of South Lanarkshire cheese as unsafe to eat has had his decision reversed by the Court of Session.

 Issuing the court’s judgment yesterday, Lord Bannatyne said that Sheriff Robert Weir, QC, had “misdirected himself in law” when he ruled that batches of Lanark Blue and Corra Linn cheese, made by Errington Cheese, had failed to comply with food safety requirements and should be destroyed. He ordered that the cheese should be released.

 The decision follows a petition from the company’s founder, Humphrey Errington who argued that the E.coli organism involved was present in “vanishingly small” amounts, and was in fact harmless.
